About the Role

This position is located in the Appellate and Supreme Court Litigation Branch of the Division of Enforcement Litigation. The Branch conducts the litigation in the U.S. Court of Appeals involving the enforcement or review of Board Orders. The incumbent serves as a General Attorney (Labor) working under the supervision of the Branch Chief or a Supervisory Attorney, preparing assigned cases involving enforcement litigation in the U.S. Court of Appeals, and litigation in the U.S. Supreme Court.

What You'll Do

  • As a General Attorney (Labor) (Appellate Litigation Attorney), GS-0905-14, your typical work assignments may include: Analyzing the entire record including the proceedings, exhibits, the Administrative Law Judge's decision, and the Board's decision and order.
  • Conducting extensive legal research and investigating the facts as well as the laws, regulations and legal precedents.
  • Preparing briefs containing a concise statement of the facts of the case and the presentation of the legal argument, including requisite citation of authority, in the manner deemed most likely to persuade the Court to sustain the Board's position.
  • Representing the Board and presenting oral arguments in the Court of Appeals in assigned cases.
  • Analyzing applicable law and facts in order to develop sound rationales for the disposition of the most difficult and novel questions of law, policy, and procedures that arise in the enforcement of the Act.
  • Independently analyzing cases to determine if opposing briefs need to be filed or if a rehearing by the Supreme Court is needed.
