About the Role
This position is located in the Office of Appeals, Division of Enforcement Litigation. The Office of Appeals reviews all appeals to the General Counsel from Regional Directors' dismissals of unfair labor practice charges filed in the agency's regional offices. The General Counsel is vested with the sole power to review and sustain or deny these appeals and his/her decisions to deny appeals in such cases are not subject to review by the Board or appeal to any court of law or equity.
What You'll Do
- →As a Attorney-Adviser (Labor) (Enforcement Appeals Attorney), GS-0905-14, your typical work assignments may include: Analyzing appeal dismissals of unfair labor practice charges to recommend whether to sustain the dismissal, remanding them for further investigation, or granting the appeal and set matters before a judge.
- →Reporting orally to the General Counsel Agenda Committee a clear and succinct statement of the pertinent facts, legal issues and policy considerations to make recommendations as to the final deposition of the case.
- →Developing written records of the decisions in sustained appeal cases to ensure offices are informed of circumstances, inferences, legal conclusions, policy determinations, theories of the case, and remedial action to be sought.
- →Analyzing appeal decisions to determine if they are appropriate and how to proceed with the view of implementing and developing policies and procedures.
- →Ascertaining what substantive legal issues are raised by the facts, circumstances and inferences, based upon evidence of sufficient probative value, and identifies the major and minor procedural issues.
