About the Role

The Commodity Futures Trading Commission's (CFTC's or Commission's) Division of Market Oversight (Division) is responsible for the regulation of the commodity futures, associated options, and swaps marketplace. Commodity futures, associated options, and swaps markets are highly innovative and global in scope. The mission of the Division is to foster markets that are free from abusive trading activity and accurately reflect the forces of supply and demand for underlying commodities.

What You'll Do

  • The DCM, SEF, and SDR Branch reviews applications of exchanges for contract market designation or swap execution facility registration, and of data repositories for swap data repository registration to ensure compliance with applicable core principles and Commission rules and policies.
  • The Branch also reviews governance, trading and market-related rules of regulated exchanges to assure that exchange rules, operations, procedures and practices meet the statutory standards of the Commodity Exchange Act (Act) and the Commission's regulations and policies.
  • In addition, the Branch reviews governance, compliance officer and conflicts-related rules of swap data repositories to assure that repository's rules, operations, procedures and practices meet the statutory standards of the Act and the Commission's regulations and policies.
  • Finally, the Branch performs short- and longer-term legal and policy studies of special market issues relating to regulated exchanges and swap data repositories.
  • As the Deputy Director for the DCM, SEF, and SDR Branch at the Commodity Futures Trading Commission (CFTC or Commission), you will serve as a key member of the agency's executive leadership team.
  • If selected for this position, you will manage the operations of the Branch and serve as a consultant and senior legal advisor to CFTC policymakers by providing them with accurate, meaningful, and properly evaluated information in all areas of the Branch's responsibilities.
  • Manages a program to identify, plan, and solve legal and policy issues and problems related to the CFTC's oversight program for regulated exchanges and data repositories.
  • These issues and problems often involve complex legal analyses and may require the development and application of new analytical techniques.
  • Reviews contract market designation and SEF registration applications from new trading facilities or platforms.
  • The reviews involve a comprehensive analysis and assessment of the facility's trading system governance, its ability to perform compliance and surveillance, and all other aspects of the trading facility's operations.
  • Reviews swap data repository registration applications.
  • The reviews involve a comprehensive analysis and assessment of the facility's data management procedures, governance, and all other aspects of the facility's operations.
  • Analyzes requests for approval of rules and rule certification filings to ensure conformance with the Act, Commission policies, and regulations.
  • These filings relate to, among other things, off-centralized-market trading procedures such as block trading, market maker and other incentive programs, trading procedures, exchange or repository governance and organization, international and domestic exchange or repository linkages, bankruptcy, and rules which relate to or restrict membership and access to exchanges or repositories.
